Quant-UX will not be liable to you (whether under the law of contract, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website:

  • to the extent that the website is provided free-of-charge, for any direct loss
  • for any indirect, special or consequential loss; or
  • for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

These limitations of liability apply even if Quant-UX has been expressly advised of the potential loss.

  • death or personal injury caused by Quant-UX's negligence;
  • fraud or fraudulent misrepresentation on the part of Quant-UX; or

You accept that, as a limited liability entity, Quant-UX has an interest in limiting the personal liability of its collaborators. You agree that you will not bring any claim personally against Quant-UX's officers or employees in respect of any losses you suffer in connection with the website.

Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect Quant-UX's officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as Quant-UX.

Unenforceable provisions

If any provision of this website disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this website disclaimer.

Indemnity

You hereby indemnify Quant-UX and undertake to keep Quant-UX indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by Quant-UX to a third party in settlement of a claim or dispute on the advice of Quant-UX's legal advisers) incurred or suffered by Quant-UX arising out of any breach by you of any provision of these terms and conditions.

Breaches of these terms and conditions

Without prejudice to Quant-UX's other rights under these terms and conditions, if you breach these terms and conditions in any way, Quant-UX may take such action as Quant-UX deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

Termination

You may stop using the Service and delete your account at any time, for instance from your account settings or by contacting us. If you are on a paid plan, termination does not entitle you to a refund of any fees already paid, except where required by applicable law or otherwise stated at the time you purchased the plan.

Quant-UX may suspend or terminate your access to the Service, with or without notice, if you breach these terms and conditions, if required to do so by law, or if we decide to discontinue the Service or a part of it.

Upon termination of your account, we will delete or anonymize your account data and prototype data within a reasonable period, in accordance with our Privacy Policy, except where we are required or permitted to retain it for longer, for instance to comply with a legal obligation or to resolve disputes.

You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

Severability

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Entire agreement

These terms and conditions constitute the entire agreement between you and Quant-UX in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.

Governing law and jurisdiction

These terms and conditions are governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. If you are acting as a consumer, nothing in this clause deprives you of any protection afforded to you by mandatory provisions of the law of the country in which you are resident.

Subject to the preceding paragraph, the courts of Germany will have exclusive jurisdiction over any dispute arising out of or in connection with these terms and conditions.

Cookies & Local Storage

Cookies are small files, which may include an anonymous unique identifier, that a website stores on your computer's hard drive through your browser. We use cookies to enable authentication and to help us debug and improve the software.

We also use your browser's Local Storage to store certain data directly on your device, such as session information and, if you use our AI Features, the API keys you provide (see the AI section below). Unlike cookies, data in Local Storage is not automatically sent to our servers and remains on your device until it is cleared.

You can configure your browser to refuse cookies or to notify you when a cookie is being set, and you can clear cookies and Local Storage at any time through your browser settings. However, if you refuse cookies or clear Local Storage, you may not be able to use some portions of the Service, and any data stored locally, such as saved API keys, will be lost.

AI

Quant-UX offers optional features that use Artificial Intelligence ("AI Features") to help you design prototypes. If you choose to use an AI Feature, the content you submit through it (including your current design and your prompts) will be transmitted to and processed by third-party providers that host the underlying Large Language Models. As of the date of this policy, these providers may include OpenAI (openai.com), Anthropic (anthropic.com), Google (google.com) and OpenRouter (openrouter.com). These providers may process data outside your country of residence, including outside the United States and the European Union. Do not submit data through the AI Features that you are not permitted or willing to share with these third-party providers, and do not submit special categories of personal data, trade secrets, or other confidential or regulated information.

To use most AI Features, you must supply your own API key(s) for the relevant third-party provider. Your API keys are stored locally in your browser and are not transmitted to or stored on Quant-UX's servers. You are solely responsible for safeguarding your API keys and for all use of, and charges incurred through, your keys, whether or not authorized by you. Quant-UX has no access to, and accepts no liability for, the loss, theft, or misuse of your API keys.

Use of AI Features through your own API keys will incur charges from the relevant third-party provider, billed directly to you under your agreement with that provider. Such charges can be significant and are entirely your responsibility. Quant-UX is not a party to, and accepts no responsibility or liability for, your agreement or dealings with any third-party AI provider, including the availability, pricing, output, or performance of their services.

Quant-UX may, at its discretion and without obligation, make limited access to certain AI models (including models hosted via OpenRouter) available for evaluation purposes without requiring you to provide your own API key. Requests made through this evaluation access may be routed through additional third parties, which may be located outside the United States or the European Union. This evaluation access is provided "as is", may be rate-limited on a per-user basis, may be restricted, suspended, or discontinued at any time without notice, and must not be used in a manner that abuses or circumvents these limits. Quant-UX reserves the right to suspend or terminate the account of any user who abuses this evaluation access.

To the fullest extent permitted by applicable law, AI Features are provided without warranties of any kind, and Quant-UX disclaims all liability for any output generated by, or reliance placed on, AI Features, and for any costs, losses, or damages arising from your use of the AI Features or any third-party AI provider.
